Human Services, Health and Benefits

The Office of Administrative Hearings conducts hearings and resolves cases involving various programs administered by the Department of Human Services; as well as cases involving benefit programs administered by other agencies; licensing of health-related occupations; enforcement of health-related regulations; and licensing of certain types of facilities.

• Decisions by the Department of Human Services about Food Stamps (SNAP), Temporary Assistance to Needy Families (“TANF”), Medicaid or Healthcare Alliance eligibility, child care subsidies, Interim Disability Assistance (“IDA”), Burial assistance, and other benefits programs
• Decisions by the Department of Health Care Finance or its contractors denying specific services to persons who receive Medicaid or Healthcare Alliance benefits
• Decisions by the Department of Health Care Finance to recoup overpayments from Medicaid providers or to terminate Medicaid provider agreements
• Decisions by providers of services to homeless persons to terminate, transfer or suspend a client; claims that a service provider has denied a client rights protected by the Homeless Services Reform Act under programs administered by the Department of Human Services
• Denials of emergency rental assistance under programs administered by the Department of Human Services
• Decisions about rehabilitation assistance by the Department on Disability Services
• Decisions by the Department on Disability Services affecting the blind vendors program
• Final condemnation orders in child support enforcement proceedings brought by the Office of the Attorney General, Child Support Services Division
• Notices of Violation issued to mental health community residence facilities by the Department of Mental Health
• Decisions concerning Low-Income Home Energy Assistance Program (“LIHEAP”) eligibility by the Energy Office, District Department of the Environment
• Notices of Infraction issued by the Department of Health for violations of sanitary and other health-related regulations
• Challenges to proposed discharges, transfers or relocations by nursing homes or community residence facilities under programs administered by the Department of Health or the Department of Mental Health
• Determinations that a dog is “potentially dangerous” or “dangerous” by the Department of Health
• Disciplinary decisions by Health Occupation Boards, if referred to the Office of Administrative Hearings
• Certain licensing decisions by the Child and Family Services Agency
